CONDITIONS OF SALE OF PROPER ATTIRE® CONDOMS
1. General Conditions.
By placing and submitting your order for purchase on the www.properattirecondoms.com website (the "Site’), you are agreeing to the terms and conditions stated on the site, the terms stated here, and any other instructions provided, from time to time, by Proper Attire.. Planned Parenthood Federation of America, Inc. ("PPFA") is the distributor of Proper Attire® condoms. The products offered for sale on this Site are offered only in the United States and you only should purchase the products for shipment to you in the United States. All orders are subject to acceptance by PPFA from time to time in accordance with its policies and practices and otherwise in its discretion.
2. Personal Use of the Condoms.
Condoms purchased on this Site are for personal use only. You may not resell the condoms. Also, the U.S. Food and Drug Administration prohibits your relabeling or repackaging the condoms and you agree not to do so. Please follow all instructions in the product pamphlet, including those about storing the condoms in a cool, dry place, and not using them after the expiration date indicated on the condom foils.
3. Prices; Payment Terms.
Proper Attire® prices indicated on this Site are in United States dollars. Prices are subject to change. Applicable taxes, handling, and shipping costs will vary depending upon your location and type of delivery requested and may change from time to time.
4. Minimum Order Amount
A minimum order amount of $9.98 is required for online orders.
5. Shipping
- Shipping and handling rates for all U.S. states (except Alaska and Hawaii) will be charged at a flat rate of $9.99 per order.
- Shipments to Alaska and Hawaii addresses will be charged at a flat rate of $18.00 per order.
- All merchandise will be shipped UPS Ground and will usually be delivered in three to 10 days, provided product is in stock and order is placed before 1 pm (ET).
- Express shipping is currently unavailable for orders placed online. We apologize for any inconvenience this may cause. However, in the interim you may place a rush order by calling W HOTELS THE STORE at 212-930-7431 24 hours a day, seven days a week, for U.S. orders.
- Shipping is currently unavailable for orders being shipped to a P.O. Box, APO or FPO address. We apologize for any inconvenience this may cause.
6. Sales Tax
- Sales tax will be charged for purchases when applicable.

If you are commenting on the condoms, please keep some samples in case we need to examine them. Please note that the toll-free number provided on the Proper Attire® packaging -- (800) 800-PLAN -- is for customers to connect to their nearest Planned Parenthood health center; it is not a customer service center for Proper Attire® condoms.
8. Inherent Characteristics of Condoms; Warranty Disclaimer.
Proper Attire Condoms are manufactured, packaged, stored, and shipped in accordance with law and high quality and safety standards. However, you acknowledge and understand that, although the proper and consistent use of condoms has been demonstrated to reduce the risk of pregnancy and the transmission of certain sexually transmitted diseases, condoms cannot completely eliminate these risks. Because condoms are made from natural materials (rubber latex), any condoms, including Proper Attire® condoms, may tear, break, slip off, or otherwise fail to work effectively, including after proper storage by you and proper use by the ultimate consumer. You acknowledge and assume these risks. PPFA DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS. You acknowledge that disclaimer and agree that PPFA shall have no liability in respect of merchandise, except for liability for returns as stated herein and/or liability associated with PPFA’s intentional misconduct or gross negligence in its manufacture, packaging, storage or ship of merchandise.
9. Condom Returns.
In order to assure our customers that any condoms we sell have been stored in proper conditions, we do not re-stock and re-sell returned condoms. Therefore, returns of Proper Attire® condoms are limited to (i) any condoms that arrive to you that you did not order, (ii) any condoms that arrive to you damaged, or (iii) any condoms that PPFA has determined, in its sole discretion, to recall. To return condoms, call the Proper Attire® distribution center at 1-800-226-7962 and request return authorization. In the case of (i) and (ii) above, requests for returns must be made within ten (10) days of receipt of the merchandise. If PPFA authorizes the return, you will be given a return authorization number. You must include that return authorization number and a written explanation of your dissatisfaction in your return package, which should be shipped to Planned Parenthood Federation of America, 601 Main Street, PO Box 188, New Windsor, MD 21776. NO RETURNS WILL BE ACCEPTED WITHOUT A VALID RETURN AUTHORIZATION NUMBER. Once the condoms are inspected, PPFA will determine what action to take. If the condoms are found by PPFA to be damaged, the merchandise will be replaced or your payment for it will be refunded.
10. Other Merchandise Returns.
All merchandise other than condoms may be returned for any reason within 30 days of purchase. You will receive a refund of the purchase price or an exchange at your request. The original cost of shipping and handling, as well as your cost of returning the products will not be refunded, unless the product arrived to you damaged. Returns should be shipped to: Planned Parenthood Federation of America, 601 Main Street, PO Box 188, New Windsor, MD 21776. We must receive the product in its original packaging and in the same condition as when delivered to the carrier for shipment to you.
